Probation Department was not assigned to oversee the IID, that is being done by Cayuga Counseling Services not Cayuga County Probation Department. AND the letter states that they want an investigation to his plea to Harrassment 2nd, which he never plead to because it was dropped and he only plead to the DWI.

I would ignore their letter directly but contact the prior atty.

Thats another thing. I dont think his prior attorney did squat for him and charged him out the butt. He didnt really fight fo rhim at all, and now we are left without much money and all these additional issues. Luckily the last two times he had to have his IID reset they waived the $75.00 charge because the device is faulty so how the heck can he be violated on that. What a mess and its really stressing my boyfriend out. He is doing his best to do what he is supposed to, working FT so he can pay for everything and his child support and he is in the middle of a nasty divorce as well. If they take his license he is totally screwed because he has a long way to drive to get to work.....we are just disgusted with the Judge and the Attorney and the DA, because we think this case has been mishandled right from the start. His arrest date was 2/19/2011 and he wasnt even sentenced till 10/17/2011.

Ok update....bf went and met with probation officer, who said the judge issued a violation of conditional discharge on 3/5/12....we were never informed of a court date and our lawyer was never contacted about this or if he was he never informed us. Can they do this to us? Even the probation officer was shocked that we didn't know anything about this supposed march 5tu court date and he says there's something screwy going on. Who would we turn to to file a complaint against the DA and judge.?

The judge can issue the violation. Notification is always spotty by the Court and probation, even to the attorney. Can they do it, yes. Should they, no. You can file complaints with the Grievance Committees of the Bar Association in your area
